Information for customers in accordance with the VVG (the Swiss law governing insurance contracts)

The following information for customers provides a clear and concise overview of the identity of the Insurer and the most important points contained in the insurance contract (Art. 3 of the Swiss law governing insurance contracts, the VVG).

Who is the Insurer?

The Insurer is Mondial Assistance International AG, called Mondial in the following text. The insurance products are sold under the ELVIA brand. The headquarters of the company is at Hertistrasse 2, 8304 Wallisellen, Switzerland. In matters relating to legal protection insurance, the Insurer is CAP Rechtsschutz-Versicherungsgesellschaft AG, based at Badenerstrasse 694, 8048 Zurich, Switzerland.

What risks does the insurance cover, and what is the scope of the insurance protection?

The insured risks and the scope of insurance cover are set out in the policy and the General Terms and Conditions of Insurance.

Who are the people covered by the insurance?

In the case of insurance policies with durations of less than one year (short-term insurance policies) the insured individuals are those specified in the policy.

In the case of insurance policies with durations of one year (annual insurance policies), the policy will specify whether the insurance protection applies to the Policy Holder alone (single person) or for the Policy Holder and the people living in the same household as the Policy Holder, together with any under-age children who do not live in the same household (family insurance).

The insured individuals are listed in the policy and the General Terms and Conditions of Insurance.

What are the important exclusions?

§        Events that have already occurred at the time of concluding the contract or booking the trip, or events that were discernible for the insured individual at the time of concluding the contract or booking the trip.

§        Events connected with epidemics or pandemics.

§        Events connected with participation in risky actions, where the individual is knowingly exposed to danger.

This list only contains the most common exceptions. Further exceptions are set out in the General Terms and Conditions of Insurance and the VVG.

How much is the premium?

The level of the premium depends on the insured risks in each case, and on the cover required. The level of the premium will be defined at the time of application, and is set out in the policy.

What are the duties of the Policy Holder and the insured individuals?

§        To fulfil their contractual and legal duties of notification, information and conduct in full (e.g. prompt notification of a case of loss/damage to Mondial).

§        To do all that they can to help minimise and clarify the loss/damage (e.g. authorising Mondial to issue the relevant documents, information etc. to third parties to clarify the case of loss/damage).

When does the insurance cover begin and end?

The beginning and end of the insurance cover are defined in the application and specified in the policy.

§        In the case of insurance policies with durations of one year (annual insurance policies), the policies will be automatically extended by a further year when they expire. Either the Policy Holder or Mondial can terminate annual insurance policies by giving notice of 3 months to the end of their terms, in writing.

§        Insurance policies with durations of less than one year (short-term insurance policies) end automatically on the day defined in the application and set out in the policy.

The insurance cover can be ended prematurely by giving notice of termination:

§        Following a case of loss/damage for which Mondial has provided benefits, as long as the notice of termination takes place at the time of the pay-out, at the latest.

§        If Mondial changes the premiums. In this case, notice of termination must reach Mondial on the last day of the insurance year.

§        In the event of insurance fraud.

This list only contains the most common causes of termination. Further causes of termination are set out in the General Terms and Conditions of Insurance and the VVG.

How do Mondial and CAP handle information?

Mondial handles information that arises from the contractual documents or the processing of the contract, and uses this in particular to establish the premiums, clarify risk, handling benefits cases, statistical evaluations and marketing purposes. The information is stored physically or electronically.

If necessary, the information is passed to involved third parties, to the extent needed. These third parties might be other participating insurers, the authorities, lawyers or external experts. Information may also be passed on in order to reveal or prevent the misuse of insurance.

General Terms and Conditions of Insurance

The insurance protection provided by the Mondial Assistance (Schweiz) (hereafter referred to as Mondial) is defined by the Insurance Policy and the following General Terms and Conditions of Insurance.

I        Common provisions relating to all components of insurance

The common provisions for all components of insurance only apply to the extent that there are no contrary provisions in the Special Provisions to the individual components of insurance.

1        Insured persons

1.1     The insurance covers whoever is listed in the insurance policy(ies). If a family policy is arranged, this will include all those who live in the same household and any of their underage children who do not live in the same household. The “Junior 26” insurance can only be completed by persons who haven’t passed their 26th birthday.

1.2     The insurance covers those people listed in accordance with Clause I 1.1 if they have their permanent residence in Switzerland or in the Principality of Liechtenstein.

1.3     The insurance covers those people listed in accordance with Clause I 1.1 if they live abroad, as long as they booked their trip in Switzerland.

2        Scope of the insurance

The insurance provides cover worldwide or in Europe, depending on the type of insurance arranged, or in accordance with the details provided in the policy.

3        Extension of insurance cover

Annual insurance policies are valid for 1 year from the commencement of insurance entered in the policy. Upon expiry, they are extended automatically by another year in each case. Either the insured person or Mondial can terminate the contract by giving a period of notice of 3 months from its conclusion, in writing.

4        Obligations in the event of loss/damage

4.1     The insured person has a duty to do everything possible to minimise the loss/damage and to clarify it.

4.2     The insured person has a duty to undertake in full his/her contractual or legal obligations with regard to notification, information or conduct (including immediate prompt notification of the insured event to the contact address specified in the common provisions).

4.3     If the loss/damage has arisen as a result of illness or injury, the insured person must ensure that the medical personnel providing treatment are freed from their duty of confidentiality with regard to Mondial.

4.4     If the insured person is also able to assert claims for which Mondial has furnished provisions against third parties, he/she must safeguard these claims and cede them to Mondial.

4.5     The following documents must be made available to Mondial at the contact address specified in the common provisions (in accordance with the insured event):

-     Proof of insurance (Policy)

-     Invoice for cancellation costs, in the original

-     Transport tickets (airline tickets, railway tickets), entry cards, receipts, etc. in the original

-     Receipts for unforeseen costs, in the original

-     Death certificate

-     Booking confirmation

-     Documents and/or official certificates that confirm that the loss/damage has happened (e.g. detailed medical certificate with diagnosis, employer’s certificate, police report, etc.)

-     Confirmation of business travel from the employer

-     Copy of passport with immigration stamp

-     Invoices for costs of medical personnel, medical products and hospitals, plus doctor’s prescriptions in the original

-     Invoices for the insured additional costs in the original

-     Record of the facts of the case

-     Missing persons notification for EDA

-     Proof of delay by airline.

5        Violation of obligations

If the person with the right to claim violates his/her obligations, Mondial can refuse or reduce its benefits.

6        Non-insured events

6.1     If an event has already taken place at the time the contract is concluded or the trip is booked, or if the event was discernible for the insured person at the time the contract was concluded or the trip was booked, there will be no right to claim benefit.

6.2     Events are not insured if they have been caused by the insured person as follows:

-     Misuse of alcohol, drugs or medical products

-     Suicide or attempted suicide

-     Participation in strikes or unrest

-     Participation in competitions and training sessions involving motor vehicles or boats

-     Participation in actions involving risks, where the individual knowingly exposes himself/herself to danger

-     Grossly negligent or pre-meditated conduct/omission

-     Commitment of a crime or offence, or the intention to do so

6.3     The insurance does not cover activities related to an insured event, e.g. costs of replacement of the insured items or police-related matters.

6.4     The insurance does not cover the following events or their consequences: war, terrorist attacks, unrest of any kind, epidemics, pandemics, natural catastrophes and incidents involving atomic, biological or chemical substances.

6.5     The insurance does not cover the consequences of events caused by official decrees, e.g. confiscation of assets, imprisonment or ban on leaving the country.

6.6     If the purpose of the trip is for medical treatment as an in-patient.

6.7     If the certifier (expert, doctor, etc.) is a direct beneficiary or relative of the insured person by blood or by marriage.

6.8     The insurance does not cover costs relating to kidnappings.

7        Definitions

7.1     Closely connected persons

Closely connected persons are:

-     Relatives (spouses, parents, children, parents-in-law, grandparents and siblings)

-     Personal partners and their parents and children

-     Carers of underage children or relatives who are in need of care and are not travelling with the insured person

-     Very close friends, with whom there is intensive contact

7.2     Europe

The European area of application includes all the nations on the European continent plus the Mediterranean and Canary Islands, Madeira and the nations that border the Mediterranean but are outside Europe. The eastern border north of Turkey is formed by Azerbaijan, Armenia and Georgia, together with the Ural mountain range.

7.3     Switzerland

The Swiss area of application covers Switzerland and the Principality of Liechtenstein.

7.4     Damage by the elements

Damage by the elements covers loss or damage caused by events involving the elements, such as high water levels, floods, storm (wind speeds of at least 75 km/h), hail, avalanche, weight of snow, rock slip, rock fall or landslide. Damage caused by earthquakes or volcanic eruptions does not count as damage by the elements.

7.5     Monetary assets

Monetary assets are cash, credit cards, securities, savings books, precious metals (as reserves, bullion or retail goods), coins, medals, loose precious stones and pearls.

7.6     Trip

A trip includes a stay of more than one day’s duration away from the usual place of residence, or a shorter trip at a location at least 30 km away from the usual place of residence, excluding journeys to work. The maximum duration of a trip within the meaning of these General Terms and Conditions is limited to a total of 92 days. For the annual travel insurance policies, the maximum duration of the trip is limited to 365 days.

7.7     Travel company

A travel company (travel organiser, travel agent, airline, car hire company, hotels, course organiser etc.) includes any company that, based on a contract, provides travel services with and for the insured person.

7.8     Public conveyance or means of transport

A public conveyance or means of transport is a method of transport that travels regularly, on the basis of a timetable, and for which a ticket has to be purchased. Taxis and hired vehicles do not count as public means of transport.

7.9     Breakdown

A breakdown is a sudden, unforeseen failure of the insured vehicle as a result of an electrical or mechanical defect, which makes it impossible to continue the journey, or which would make it illegal to continue the journey. The following are put in the same category as a breakdown: tyre faults, lack of fuel, vehicle keys locked in the vehicle and discharged battery. Loss of or damage to the vehicle key and incorrect fuel do not count as a breakdown and are not covered by insurance.

7.10   Personal injury

An injury is the sudden, unintended damaging effect of an unusual factor on the human body.

7.11   Motor vehicle accident

An accident is any damage to the insured vehicle, caused by a sudden violent external event, which makes it impossible to continue the journey, or which would make it illegal to continue the journey. In particular, this includes events caused by impact, collision, turning over, crashing, subsidence and immersion.

7.12   Severe illness / Severe consequences of injury

Illnesses and/or consequences of injury are regarded as severe if they result in a temporary or permanent inability to work, or if they cause an absolute inability to travel.

8        Complementary clause

8.1     If an insured person has an entitlement under a different contract of insurance (voluntary or compulsory insurance), the cover is limited to that part of our benefits that exceeds that provided by the other insurance contract. Overall costs will only be reimbursed one single time.

8.2     If Mondial has nevertheless provided benefits for the same loss/damage, these shall be regarded as an advance payment, and the insured person shall cede his/her entitlement to claim against the third party (third-party, voluntary or compulsory insurance) to Mondial to the same extent.

9        Period of limitation

The period of limitation for claims resulting from the insurance contract is 2 years from the time of the event upon which the duty to provide the benefit is based. (Exception: air accident; in this case, the period of limitation is 5 years.)

10      Hierarchy of standards

The “Special provisions relating to the individual components of insurance” take precedence over the “General provisions relating to all components of insurance”.

11      Place of jurisdiction and applicable law

11.1   Actions against Mondial may be filed in the court at the company’s headquarters, or at the Swiss place of residence of the insured person or the person with an entitlement to claim.

11.2   The Swiss law governing the insurance contract (the Bundesgesetz über den Versicherungsvertrag, or VVG) is applied as a supplement to these provisions.

II       Special provisions relating to the individual components of insurance

A1      Cancellation

1        Scope

1.1     Insurance protection begins on the day on which the insurance policy is issued, and ends when the insured trip begins. The beginning of the trip is taken as the time the insured person enters the booked means of transport, or the booked hotel, etc., if no means of transport has been booked.

1.2     Insurance protection only exists if the insurance has been taken out within 8 days of issue of the final confirmation of booking by the booking office. Issue of the insurance policy is regarded as its arrangement.

1.3     In the case of annual insurance policies, initial arrangement must take place before the beginning of any cost-liable notice of termination period at the travel company, or must occur at the same time as the travel booking is made.

2        Sums insured

The sums insured are given in the Overview of insurance benefits.

3        Insurance benefits

3.1     Cancellation costs

If the insured person cancels the contract with the travel company as a result of an insured event, Mondial will pay the contractually owed cancellation costs, up to the amount of the agreed sum insured. Where tickets for an event are not part of a package arrangement, an excess of CHF 50 will be deducted per ticket.

3.2     Delay to start of trip

If the insured person suffers a delay to the start of the trip as a result of an insured event, Mondial will pay the following costs instead of the costs of cancellation (up to a maximum of the level of the cost of a cancellation):

-     the additional travel costs arising in relation to the delayed departure and

-     the costs of the unused part of the trip, in proportion to the package price (excluding transport costs). The date of the outward journey is regarded as a used day of the package.

3.3     The expenses of disproportional or repeated administrative costs or for the insurance premium will not be reimbursed.

4        Insured events

4.1     Illness, injury, death and pregnancy

1     Severe illness, severe injury, complications of pregnancy or as a result of death (in so far as the relevant event has arisen after the time of booking)

-  of the insured person;

-  of a person travelling with the insured person, who has booked the same trip and has cancelled it;

-  of a person who is closely connected to the insured person, but who is not travelling with the insured person;

-  of the person deputising for the insured person at his/her place of work, if the presence of the insured person is indispensable.

If several people have booked the same trip, it can only be cancelled by a maximum of 6 people.

2     Psychological illness. Insurance cover only exists if

-  the inability to travel and work is certified by a psychiatrist, and

-  the inability to work is proven by providing a confirmation of absence from the employer.

3     In the event of chronic illness, insurance protection only applies if the trip has to be cancelled as a result of an unexpected acute worsening, as certified by a doctor. It is a prerequisite that the state of health of the insured person was stable and that the person was fit to travel at the time of booking.

4     In the event of pregnancy, insurance protection only applies if the pregnancy occurred after the time of booking the trip, and if the date of return is after the 24th week of pregnancy, or if the pregnancy has occurred after the time of booking the trip, and a vaccination that would present a risk to the unborn child is recommended for the destination of travel.

4.2     Damage to property at the place of residence

If there has been serious damage to the property of the insured person at his/her permanent place of residence as a result of theft, fire or damage by the elements, and the presence at home of the insured person is therefore indispensable.

4.3     Delay and failure of the means of transport for the outward journey

If it becomes impossible to start the booked trip as a result of a delay or failure of the means of public transport used on the outward journey to reach the point of departure anticipated in the travel package.

4.4     Failure of the vehicle on the outward journey

If the private vehicle or taxi becomes undriveable during the direct trip to the point of departure anticipated in the travel package, as a result of an accident or breakdown. Problems with keys and fuel are not covered by insurance.

4.5     Strikes

If strikes make it impossible for the trip to be undertaken.

4.6     Dangers at the destination of travel

If war, terrorist attacks, unrest of any kind, natural catastrophes or radioactive radiation at the destination of travel endanger the life of the insured person, and the official Swiss advice (from the Federal Department of Foreign Affairs (DFA)) is against undertaking the trip.

4.7     Unemployment / unexpected start of a new job

If the insured person unexpectedly starts a new job or receives a notice of termination of employment through no fault of his/her own within the last 30 days before the outward journey.

4.8     Summons from the authorities

If the insured person unexpectedly receives a summons to appear as a witness or as a juror in a court. The court dates must lie within the period of travel.

4.9     Theft of passport or identity card

If the passport or the identity card of the insured person is stolen immediately before departure, making it impossible to start the trip.

NB: Emergency passport offices are located at various airports.

5        Non-insured events (as a supplement to Clause I 6: Non-insured events)

5.1     Poor course of recovery

If an illness or the consequence of an accident, an operation or a medical intervention already exists at the time of booking the trip, and recovery is not complete by the date of travel. If recovery from the consequences of an operation/medical intervention already planned at the time of booking the trip, but not undertaken until afterwards, is not complete by the date of travel.

5.2     Cancellation by the travel company

If the travel company can not fulfil the contractual benefits in full or in part, or cancels the trip, or has to cancel as a result of the actual circumstances, and has to reimburse the costs of benefits not provided on statutory grounds. The actual circumstances, as a result of which the trip would have to be cancelled, would include advice from the Federal Department of Foreign Affairs (DFA) against travel to the affected area.

5.3     Official directives

If official directives make it impossible to carry out the booked trip according to plan.

6        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

In order to be able to call upon the Mondial benefits, the person with the entitlement to claim must cancel the booked trip with the travel company or the person who is renting immediately upon the occurrence of the insured event, and then notify Mondial of the loss/damage in writing.

A4      ALL RISK cancellation (extension of insurance cover for the Cancellation component)

The All Risk extension of the Cancellation component of the insurance will cover payment of up to a maximum of 80% of the cancellation costs contractually owed by the insured person, up to the level of the agreed sum insured, if events occur that are not covered by the Cancellation insurance but provably affect the insured person directly and personally, and lead to the cancellation of the insured trip, with the exception of 

-     The events specified as fundamentally non-insured under Clause I 6 (General Terms and Conditions of Insurance),

-     Cancellations associated with multiple simultaneous bookings and/or overlapping journey times

-     An error in the choice of destination of travel, means of travel or travel agent/partner in the travel contract.

 

In order to be able to call upon the benefits covered by the All Risk insurance extension to the Cancellation component of the insurance cover, the claimant must send a written form of confirmation and/or written proof of the event leading to the cancellation (e.g. confirmation from the authorities or other official sources, employers, insurance policies, lawyers, notaries public or tax consultants, doctors or veterinaries) to Mondial, in addition to the documents to be provided in the event of a claim as are already listed in the applicable Common Provisions relating to all Components of Insurance.

 

In addition, the Special Provisions of the Cancellation component of insurance relating to Scope, Sum insured and Obligations in the event of loss/damage will also apply.

B       Assistance

1        Sums insured

The sums insured are given in the Overview of insurance benefits.

2        Insured events and benefits

In the case of medical benefits, the Mondial-Assistance doctors have the sole right to decide upon the type and timing of the measure undertaken.

The following benefits must in any event be requested by telephone through the Mondial emergency call centre:

2.1     Assistance benefits

1     Transfer to the nearest suitable hospital

If the insured person becomes seriously ill, or is seriously injured, or if an unexpected worsening of a chronic illness, certified by a doctor, occurs during the trip, Mondial-Assistance will organise and pay for transfer into the nearest hospital suitable for the treatment, based on an appropriate medical diagnosis.

2     Repatriation with medical care to a hospital at the place of residence

If medically necessary, Mondial-Assistance will organise and pay for repatriation with medical care to a hospital suitable for the treatment at the place of residence of the insured person.

3     Repatriation without medical care to the place of residence

Based on an appropriate medical diagnosis, and the prerequisites of Clause II B 2.1.1, Mondial-Assistance will organise and pay for repatriation without accompaniment by medical carers to the place of residence of the insured person.

4     Return travel caused by interruption of trip by traveller or member of the family on the same trip

If a closely-connected person or member of the family on the same trip is repatriated to his/her place of residence, or the trip has to be interrupted for some other insured reason, and the insured person would have to continue the trip on his/her own, Mondial-Assistance will organise and pay for the extra costs for the additional return journey (first-class train ticket, economy- class air ticket) for the insured person and/or the insured family member.

5     Care for underage children on the same trip

If both parents, or the only parent taking part in a trip, have to be repatriated to their place of residence, Mondial-Assistance will organise additional care for the underage children who would have to continue the trip or return home alone, and will pay the costs for the outward and return journey of a carer (first-class train ticket, economy-class air ticket).

6     Return travel caused by the illness, injury or death of a closely connected person at home, or deputising person at the place of work

If a closely connected person at home or a deputy at the place of work becomes severely ill, is severely injured or dies, Mondial-Assistance will organise and pay for the extra costs for the additional return journey (first-class train ticket, economy-class air ticket) to the permanent place of residence of the insured person.

7     Premature return for other important reasons

If the property of an insured person at their place of residence has been severely affected as a result of theft, fire or damage by water or the elements, Mondial-Assistance will organise and pay for the extra costs for the additional return journey (first-class train ticket, economy-class air ticket) for the insured person to his/her place of residence.

8     Temporary return

Mondial-Assistance will also organise and pay for the temporary return (first-class train ticket, economy-class air ticket) of an insured person to his/her place of residence (outward and return) for the same reasons as under Clause II B 2.1.6 and II B 2.1.7. The costs for the unused part of the trip will not be reimbursed.

9     Repatriation of the body in the event of death

If an insured person dies, Mondial will pay for the costs of cremation away from the home nation, or the extra costs to fulfil the international agreement on the conveyance of corpses (minimum requirements such as a lead coffin or lining) plus the return carriage of the coffin or urn to the last place of residence of the insured person. Disposal of the lead coffin is also covered.

10   Return travel caused by unrest, terrorist attacks, natural catastrophe or strike

If it can be proven that unrest, terrorist attacks, natural catastrophes or strikes at the destination of travel make it impossible for the trip to continue, or put the life and property of the insured person at definite risk, Mondial-Assistance will organise and pay for the extra costs for the additional return journey (first-class train ticket, economy-class air ticket) of the insured person.

11   Return travel caused by failure of the means of transport

If the means of public transport booked or used for the trip fails, and continuation of the trip is therefore not possible, Mondial-Assistance will organise and pay for the extra return journey or the delayed onward journey of the insured person. Delays and diversions of the means of public transport booked or used do not count as failure. There is no entitlement to claim for breakdowns or accidents involving private vehicles used to undertake the trip, whether the insured person is the driver or a passenger.

12   Effects of the theft of documentation

In the event of the theft of personal documents (passport, identity card, conveyance tickets and accommodation vouchers), temporarily making it impossible to continue the trip or return to Switzerland, Mondial will pay the extra costs of the stay (hotel, cost of transport on site, additional costs for return journey) up to a maximum of CHF 2,000.– per event, providing the responsible police authorities have been promptly informed.

2.2     Visiting trip

If the insured person has to be hospitalised abroad for more than 7 days, Mondial-Assistance will organise and pay for a visiting trip (first-class train ticket, economy-class air ticket, medium-class hotel) for a maximum of two closely connected people, up to a maximum of CHF 5,000.–.

2.3     Mondial service benefits

1     Advance payment to a hospital

If the insured person has to be hospitalised abroad, Mondial-Assistance will, if necessary, provide an advance payment of the hospital charges, up to CHF 5,000.–. The advance payment must be repaid to Mondial-Assistance within 30 days of discharge from the hospital.

2     Travel Hotline

The Travel Hotline (N) is available to the insured person without restriction throughout the duration of the trip.

2.4     Reimbursement of travel costs

1     Reimbursement of the costs of the unused part of the trip

If an insured person has to interrupt the trip as a result of an insured event, the costs of the unused part of the trip will be reimbursed by Mondial-Assistance in proportion to the price of the insured package. Reimbursement is limited to the sum on the policy. If the Policy does not indicate a particular amount, the compensation will be limited to the amount of the insured cancellation costs. No reimbursement will be made for the costs of the homeward journey originally booked. A benefit is inapplicable if there is an entitlement to a repeat trip as a result of supplementary insurance.

2     Unforeseen expenses for repatriation, extra return travel, interruption of travel or delayed return travel

If any unforeseen expenses occur in connection with an insured event (taxi, telephone costs etc.) Mondial-Assistance will pay up to CHF 750.– per person for these costs.

3        Non-insured events and benefits (as a supplement to Clause I 6: Non-insured events)

3.1     Failure of agreement by the Mondial emergency call centre

If the Mondial emergency call centre has not agreed in advance to the benefits.

3.2     Interruption by the travel company

If the travel company can not fulfil the contractual benefits in full or in part, or interrupts the trip, or has to interrupt or cancel as a result of the actual circumstances, and has to reimburse the costs of benefits not provided on statutory grounds and/or pay the costs of return travel. The actual circumstances, as a result of which the trip would have to be cancelled or interrupted, would include advice from the Federal Department of Foreign Affairs (DFA) against travel to the affected area.

3.3     The costs of out-patient or in-patient treatment are not covered by Mondial-Assistance.

4        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

C       Search and rescue costs

2.1     If the insured person is registered as missing abroad, or has to be rescued from a physical emergency, Mondial-Assistance will pay the necessary search and rescue costs.

2.2     In any case, the search and rescue must be requested from the Mondial emergency call centre by telephone:

D       Repeat trip

1        Sums insured

The sums insured are given in the Overview of insurance benefits.

2        Insured event and benefit

2.1     The insured person is entitled to claim a repeat trip if he/she has been repatriated to his/her place of residence by the Mondial emergency call centre on medical grounds during the period of insurance.

2.2     When the insured event occurs in accordance with Clause II D 2.1, the insured person will receive a travel voucher to the value of the package booked before departure. Unused benefits of the package and reimbursement following repatriation will be settled by the entitlement to reimbursement.

3        Non-insured events (as a supplement to Clause I 6: Non-insured events)

If the repatriation of the person entitled to claim has not been arranged by the Mondial emergency call centre.

4        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

E       Auto-Assistance

1        Insured vehicle

The motor vehicle driven by the insured person (cars and motor caravans up to 3.5 t plus motorbikes). Approved camping trailers and caravans are also insured.

2        Scope

The insurance protection applies to events in Europe. Insurance cover is not interrupted by transportation by sea, as long as the points of departure and arrival lie within this area of validity.

3        Sums insured

The sums insured are given in the Overview of insurance benefits.

4        Insured events and benefits

All the Auto-Assistance must in each case be requested from the Mondial-Assistance centre by telephone (conversations with the Mondial-Assistance centre will be recorded): Tel. +41 44 202 00 00

4.1     Breakdown help / recovery / rescue

1     If the vehicle can no longer be driven as a result of a breakdown or an accident, Mondial-Assistance will organise and pay for breakdown help at the location of the event, or recovery to a suitable garage nearby.

2     The costs of rescue after an accident (recovery of the vehicle onto the road) are insured up to CHF 2,000.–.

4.2     Overnight stay / travel home / hired car

If the vehicle has been stolen, or can not be repaired in a nearby garage on the same day (within 48 hours if abroad, for reasons of expertise) after a breakdown or accident, Mondial-Assistance will organise one of the three following benefits after receiving a call:

4.2.1  Overnight stay

If the vehicle can not be repaired on the same day, or if the return or onward journey is impossible on the same day in the case of theft, Mondial-Assistance will organise and pay for an overnight stay in Switzerland up to CHF 120.– per passenger. When abroad, this will be extended to a maximum of two overnight stays up to CHF 120.– per passenger and night.

4.2.2  Travel home

Travel home by public transport for all passengers to the place of residence of the person insured (in Switzerland: first-class train ticket / abroad: first-class train ticket or economy-class air ticket if the train journey exceeds 6 hours). If the return journey in Switzerland takes place by taxi because there is no public transport, reimbursement of these costs will be to a maximum of CHF 300.–.

4.2.3  Hired car

In the case of events that occur abroad, Mondial-Assistance will organise and pay for a hired car for the onward or return journey for a maximum of 5 days and up to CHF1,500.–. Fuel costs and other running expenses will not be paid. The insured person has a duty to fulfil the contractual terms and conditions of the car hire company.

4.3     Taxi costs

If any taxi costs arise in conjunction with an insured event in accordance with Clause II E 4.2, Mondial-Assistance will pay for these, up to a maximum of CHF 100.– per event.

4.4     Return transport for vehicle

If the vehicle cannot be repaired the same day in Switzterland and abroad within 48 hours, Mondial-Assistance will organise and pay for the return transport of the undriveable or recovered vehicle to the nearest repair shop at the place of residence of the person insured. In the case of return transport from abroad, the costs of return transport will only be paid if the transport costs are less than the current value of the vehicle after the event. If the vehicle is not transported back to Switzerland, Mondial-Assistance will organise disposal and pay the duties involved.

4.5     Driving back by chauffeur

If the driver is seriously ill, seriously injured or dies, and no other traveller on the trip can drive the vehicle back, Mondial-Assistance will organise and pay for the other passengers and the vehicle to be driven back to the place of residence of the insured person by a chauffeur.

4.6     Delivery of replacement parts abroad

If the necessary replacement parts can not be procured in the nearby suitable garage after the event, Mondial-Assistance will organise and pay for immediate delivery where possible. The costs of the replacement parts are not insured.

5        Non-insured events (as a supplement to Clause I 6: Non-insured events)

5.1     If Mondial-Assistance has not agreed in advance to the benefits in accordance with Clause II E 4: Insured events and benefits.

5.2     The benefits in accordance with Clause II E 4.2 can only be claimed if the breakdown help/recovery has been organised in advance by Mondial-Assistance in accordance with Clause II E 4.1.

5.3     If the vehicle is not in a condition that meets the applicable traffic law provisions at the time of the event, or if the service tasks recommended by the manufacturer have not been carried out.

5.4     Breakdowns and accidents that happened away from public roads or on unofficial roads.

5.5     Breakdowns and accidents that happened on roads forbidden by law or by the authorities.

5.6     If the event concerns a vehicle used for business or a hired car.

5.7     If the event is caused by vandalism or by the elements.

5.8     The insurance does not cover damage to the vehicle nor to goods carried in it, nor to any consequent costs.

5.9     The insurance does not cover the costs of repair and replacement parts.

5.10   Mondial-Assistance does not accept liability for any loss/damage caused by a service provider instructed by you.

6        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

6.1     In order to be able to claim Assistance benefits, the Mondial emergency call centre must be informed immediately of the event or illness:

6.2     Any claims for loss/damage caused to insured vehicle by a service provider instructed by Mondial-Assistance in connection with an insured event must be asserted directly against the service provider and/or party responsible.

F       Flight delay

1        Sums insured

The sums insured are given in the Overview of insurance benefits.

2        Insured event and benefit

If a connection between two flights is missed because of a delay of at least 3 hours caused solely by the first airline, Mondial will pay for the extra costs of continuing the journey (hotel costs, costs of rebooking, telephone charges).

3        Non-insured events (as a supplement to Clause I 6: Non-insured events)

If the insured person him-/herself is responsible for the delay.

4        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

In order to be able to claim Mondial-Assistance benefits, the Mondial emergency call centre must be informed of the event immediately upon return to Switzerland, in writing.

H       Private Medical

1        Insured persons

The persons insured according to Clause I 1, as long as they are not older than 80 years of age.

2        Sums insured

The sums insured are given in the Overview of insurance benefits.

3        Scope

3.1     The insurance is valid for travel throughout the world, with the exception of Switzerland, the Principality of Liechtenstein and the legal nation of residence of the insured person.

3.2     The insurance cover begins on the date specified in the proof of insurance (policy), but at the time of payment at the earliest. If the date is missing, then the start of the insurance will apply from the issue date of the policy.

3.3     The costs for treatments by doctors and in hospital will be met for up to 90 days beyond the agreed period of insurance, as long as the illness or accident occurred during the insured time.

3.4     Following the end of this insurance cover, Private Medical can be rearranged after a waiting time of 4 weeks. If it emerges at the time of loss/damage that this waiting time was not maintained, then cover will not exist.

4        Insurance benefits

Mondial provides its benefits as a supplementary insurance to the statutory social insurances in Switzerland (health insurance, accident insurance, etc.) and any additional insurances for emergency hospital treatment and emergency out-patient treatment costs that they do not fully cover.

4.1     In the case of an accident or illness, Mondial will pay for the following listed medical benefits in the relevant country of travel, as long as the necessary medical intervention has been requested by a certified doctor or dentist, or by a person with the relevant operational approval:

-     Treatment measures, including medication

-     Hospital treatment

-     Treatment by a state registered chiropractor

-     Hire of medical aids

-     In the event of an accident: initial provision of prostheses, spectacles, hearing aids, etc

-     Repair or replacement of medical aids if these have been damaged by an accident requiring medical treatment

-     Transport to the nearest suitable hospital for treatment

-     Dental treatment resulting from an accident, up to a maximum of CHF 3,000.–

4.2     As long as the doctors at the Mondial emergency call centre have given their express approval, Mondial will also pay the necessary costs of in-patient treatment in a private ward. Approval for treatment in a private ward must be obtained by telephone from the Mondial emergency call centre in every case (conversations with the emergency call centre will be recorded):

4.3     Limitation and exclusion of service

4.3.1  If there is no Swiss health and/or accident insurance cover, Mondial will only pay 50% of the overall documented costs for hospital and out-patient treatment that would exceed the obligatory part of the Swiss health and/or accident insurance cover, as long as these costs have arisen as a result of illness or injury. No further services will be provided in such cases.

4.3.2  In the event of injury or illness, Mondial will pay the necessary costs of treatment in the private ward only up to the time at which the repatriation/return travel of the insured individual is possible, in the sole opinion of the doctors at the Mondial emergency call centre.

4.3.3  There is no entitlement to claim payment or repayment of the costs of treatment in the private ward without the express agreement in advance of the doctors at the Mondial emergency call centre.

4.3.4  The doctors at the Mondial emergency call centre will approve or refuse their agreement to treatment in the private ward according to Clause II H 4.2 at their own discretion, taking account of the local medical conditions in the relevant country of travel, and after weighing up the medical necessity/suitability of the treatment to be undertaken. If the insured individual undergoes treatment in a private ward in spite of the lack of approval by the doctors at the Mondial emergency call centre, or their express referral to a general ward, this will be at the sole responsibility and cost of the insured individual.

5        Insured events

Accidents and illnesses for which emergency medical intervention is appropriate.

6        Non-insured events (as a supplement to Clause I 6: Non-insured events)

6.1     Accidents and illnesses that were already present when the insurance cover started, together with their consequences. Complications, worsening or relapse, particularly for chronic and repeated illnesses, and independently of whether they were already known to the insured person at the time the insurance cover started.

6.2     Investigation and treatment of dental and jaw diseases.

6.3     Investigation and treatment of conditions of tiredness and exhaustion, as well as nervous or psychological illnesses.

6.4     Investigation and treatment of malignant diseases, including checks.

6.5     Gynaecological, paediatric or general check-ups.

6.6     Prophylactic medication, sleeping tablets, tranquillisers, vitamins, homeopathic medications, vaccinations, first-aid kits, amphetamines, hormones and cholesterol-reducing drugs.

6.7     Pregnancy, abortion and birth, together with any complications, and the consequences of contraceptive or abortion measures.

6.8     Accidents while driving a motor vehicle for which the insured person does not fulfil the statutory requirements.

6.9     Accidents while carrying out manual work.

6.10   Accidents while parachute jumping or piloting aircraft or flying devices.

6.11   Massages and well-being treatments, plus cosmetic surgery.

6.12   Accidents during military service.

6.13   No excess costs (or franchises) will be paid for the statutory social insurance schemes (nursing care insurance, accident insurance, etc.) or any supplementary insurances.

7        Cost credit

7.1     Mondial provides cost credits as part of this insurance and as a supplement to the statutory social insurance schemes (nursing care insurance, accident insurance, etc., and analogous insurance schemes in the countries where the insured person has his/her main place of residence or his/her main health insurance provision) and any supplementary insurance schemes for all in-patient treatment in hospital. The insured person is still the debtor in relation to the service provider (doctor, etc.) for all out-patient treatments carried out locally.

8        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

8.1     Mondial must be informed in writing immediately after the occurrence of the event (cf. Clause I 12: Contact address).

8.2     The insured person must, at the request of Mondial, be willing to undergo a medical inspection by the company doctor at any time.

J        Travel baggage

1        Insured items

The insurance covers the travel baggage of the insured person, including souvenirs collected during the trip, i.e. all items owned by the insured person and taken on the trip for personal use or handed over to a transport company for conveyance.

2        Scope

The insurance applies worldwide or in Europe, depending on the insurance cover agreed or in accordance with the details on the policy. The permanent place of residence of the insured person is excluded.

3        Sums insured

The sums insured are given in the Overview of insurance benefits.

4        Insured events and benefits

4.1     For

-     Theft

-     Robbery (theft involving the threat or use of violence against the insured person)

-     Damage and destruction

-     Loss and damage during conveyance by a public transport company

-     Delayed delivery by a public transport company

the following benefits will be provided, taking account of the agreed sum insured:

1     For a complete write-off or loss, the actual purchase price of the insured item will be repaid. If this is lower at the time the damage occurred, then the lower sum will be paid.

2     For partial loss/damage, the cost of repair of the damaged item will be limited to the current value.

3     For film, photographic and video equipment, music equipment (MP3 player, Discman, etc.) and for skis, snowboards and bicycles, the current value will be repaid. The current value will be taken as the actual purchase price minus an annual depreciation of 20%, starting from 1 year after purchase (amortisation).

4     For films, data carriers, image carriers and sound media, the material value will be repaid.

5     In the case of delayed delivery by a public transport company, the recompense for indispensable purchases and hire charges will be limited to a maximum of 20% of the agreed sum insured.

6     For personal and vehicle papers, and for keys, the costs are limited to the initial costs of procurement.

7     Scratch and wear damage on bicycles will be repaid to a maximum of CHF 200.–.

8     For travel souvenirs, a maximum of CHF 300.– will be paid.

4.2     In the event of robbery of monetary assets, the maximum repayment will be CHF 1,000.–, with a maximum of CHF 2,000.– for the robbery of tickets (train tickets, air tickets, etc.)

4.3     Musical instruments, sports equipment, bicycles, baby buggies, rubber dinghies and folding canoes are only insured during transport by the public transport companies.

4.4     The insured person is subject to an excess of CHF 200.– per case of loss/damage by theft.

5        Non-insured items

1     Motorboats, ships, surfboards and aircraft, including accessories in each case

2     Valuable items covered by special insurance

3     Securities, deeds, business papers, travel tickets and vouchers, cash, credit and customer cards and stamps (see Clause II J 4.2 for exceptions)

4     Computer hardware (desktop, laptop, beamer, accessories, handheld, etc.), mobile phone devices, navigation equipment, and all kinds of software

5     Valuable items left in a vehicle (locked or unlocked)

6     Items left on a vehicle, or overnight (10 pm to 6 am) in or on a vehicle where the insured person is not sleeping

7     Precious metals, loose precious stones and pearls, stamps, retail goods, goods samples, items with an artistic or collectable value and occupational tools

8     Film, photographic and video equipment, jewellery and furs, in so far as they are within the area of responsibility of the transport company while they are being conveyed by public transport

9     Spectacles against damage and destruction

10   Hearing aids and hearing aid accessories

11   Theft, loss or destruction of monetary assets

6        Non-insured events (as a supplement to Clause I 6: Non-insured events)

Loss/damage that can be traced back to the following causes are not insured:

-     Neglect of the general duty of care by the insured person

-     Misplacement, loss and abandonment

-     Abandonment or leaving behind (even for a short time) of items in a place accessible to anyone outside the direct personal area of influence of the insured person

-     Taking care of a valuable item in a manner that is inappropriate to its value (cf. Clause J 7: Duties of conduct while travelling)

-     Pearls and precious stones falling from their settings

-     Temperature and weathering effects, and the effects of wear and tear

-     The direct or indirect effects caused by unrest, plunder, authorities and strikes

7        Duties of conduct while travelling

Valuable items such as furs, jewellery, watches with or without precious metals, precious stones or pearls, laptops, photographic, film, video and sound equipment, including accessories in each case, must, if they are not being worn or used, be kept in a locked room, not generally accessible. Even there, they must be kept under separate lock and key (suitcase, cupboard, safe). The manner in which the item is kept must be appropriate to its worth in each case.

8        Obligations in the event of loss/damage (as a supplement to Clause I 4: Obligations in the event of loss/damage)

8.1     The cause, circumstances and extent of the event must be confirmed by the insured person immediately and in detail:

1     by the nearest police station to the location of the event in the case of theft or robbery;

2     by the responsible third party or by the travel or hotel manager in the case of damage by the transport company;

3     by the responsible public transport company in the case of loss or delayed delivery.

8.2     If the loss or damage during transport by a public transport company is only discovered after delivery at home, then the facts of the case must be reported in writing within 2 working days to the responsible transport company, and confirmed by them.

8.3     The level of damage must be proven by original receipts. If this is not possible, then Mondial will be able to reduce or refuse its benefits.

8.4     The insured event must be reported immediately in writing to Mondial. The claim must be submitted with justifications and receipts.

8.5     Damaged items must be kept available to Mondial until the final settlement of the claim, and must be sent at the cost of the insured person for inspection upon demand.

K       Air accident

1        Scope

1.1     Insurance cover extends beyond the agreed duration of the contract until the end of the flight, if an insured flight departs later or lasts longer than timetabled, for reasons that are the responsibility of the airline.

1.2     In the case of military or terrorist events, the validity of the insurance cover will be maintained beyond the agreed duration of the contract, for 1 year from the time of the kidnapping, parachute jump or emergency landing. This cover only applies with the precondition that the insured person was him-/herself demonstrably not active nor a participant in stirring up the relevant events.

2        Sums insured

The sums insured are given in the Overview of insurance benefits.

3        Insurance benefits

3.1     In the event of death

The agreed sum insured, if the insured person dies from the consequences of an accident within 5 years after the accident. For children up to the age of 16, the maximum compensation amounts to CHF 20,000.–.

1     Payment of this capital sum is made to the legal heirs, unless the insured person has left behind instructions to the contrary in writing.

2     If the accident leads to the death of the insured person, the agreed sum will be paid out with a deduction for any disability benefit already paid for the same accident.

3.2     In the event of disability

The capital sum is calculated in accordance with the following principles, if the insured person suffers permanent physical or psychological damage to his/her health within 5 years of the accident, as a result of the accident.

1     The disability capital will be calculated on the basis of the degree of disability and the sum insured, as agreed in the insurance document. The benefits are limited to 100% of the agreed capital. For children up to the age of 16, the maximum compensation amounts to CHF 300,000.–.

3     Where the loss or inability to use is partial, the level of disability will be reduced accordingly.

4     If several parts of the body or organs are affected simultaneously, the level of disability (which can be 100% of the sum insured at the most) will be given by adding the individual losses.

5     If cases occur that are not listed above, the level of disability will be established by reference to the above percentages.

6     If previous physical defects worsen the consequences of the accident, these will not contribute to a higher disability compensation, as if the accident had happened to a physically intact person. If parts of the body had already been lost or were unusable before the accident, in full or in part, the level of disability indicated by the above principles will be deducted.

7     Compensation will only be paid for psychological or nervous damage in so far as this can be traced back to an organic illness of the nervous system caused by the accident.

3.3     Maximum liability / Maximum benefit

If the same event leads to the disability or death of several persons covered by Mondial’s insurance, the compensation to be paid by Mondial for all the people insured by Mondial will be limited to the maximum amount. If the claims exceed this amount, the maximum sum of CHF 10,000,000.– will be distributed proportionately.

4        Insured events

4.1     Accidents

Accidents caused by civilian flights, suffered by the insured person as a legal passenger in any aircraft on the ground (including when entering or leaving) or in the air.

4.2     Accidents connected to military or terrorist events

1     On board the aircraft, as long as the accident is caused by people who are also on board, or by dangerous materials smuggled onto the aircraft

2     During imprisonment after a hijack of the aircraft, during involuntary periods following a parachute jump to save life, or an emergency landing, or on the subsequent direct return journey to the place of residence of the insured person, or onward journey to the place of destination.

4.3     Outbreak of war

1     In which Switzerland or one of its neighbouring countries is a participant

2     Between only individual countries among Great Britain, CIS, USA, People’s Rpublic of China, or between one of these countries and a European state, the insurance cover lapses for accidents as result of war or unrest in any case 2 days after break-out of hostilities. If, however, the deprivation of liberty, the parachute jump or the emergency landing has already taken place, the insurance only lapses one year after the event.

L       Excess insurance (CDW)

1        Insured vehicle

The insurance extends to the vehicle hired by the insured person, up to 3,500 kg overall weight. Vehicles of over 3,500 kg overall weight, taxis and driving school vehicles are not covered by the insurance.

2        Scope

2.1     The insurance is valid worldwide, with the exception of Israel and Jamaica.

2.2     The insurance cover starts on the relevant date entered into the contract of hire and ends with the date entered for this purpose in the contract of hire, and with the return of the vehicle to the car hire company at the latest. The insurance protection covers loss/damage arising within the period of the contract.

3        Sums insured

The sums insured are given in the Overview of insurance benefits.

4        Insurance benefits

4.1     The insurance acts as a supplementary insurance for hired vehicles. In the event of damage, Mondial will repay the insured person any excess charged by the hirer (or by another insurance company).

4.2     The level of insurance cover is set according to the level of the excess in each case, but is limited to the maximum sum insured.

5        Insured events

5.1     The insurance covers the excess charged as a result of damage to the hired vehicle or theft of the hired vehicle during the period of hire. An event covered by insurance from another source and a resulting excess is a precondition for compensation.

5.2     If the insured damage in accordance with Clause II L 5.1 does not amount to the value of the excess, then Mondial will pay the damage, as long as it has involved an insured event

6        Non-insured events (as a supplement to Clause I 6: Non-insured events)

6.1     Damage for which the insurance provided does not require an excess.

6.2     Damage caused by gross negligence on the part of the driver.

6.3     If the driver of the vehicle has caused the damage while in a state of drunkenness (exceeding the statutory alcohol limit in the relevant country), or under the influence of drugs or medication.

6.4     Damage associated with a breach of contract with regard to the car hirer is not covered.

6.5     Damage occurring on roads that are not public or not official is not insured.

6.6     Damage to caravans and other types of trailer is not insured.

M       Legal protection

1        Subject and scope

The insured person is entitled to legal protection only in connection with travel outside Switzerland and the Principality of Liechtenstein. The risk is borne by CAP Rechtsschutz-Versicherungsgesellschaft AG, which has its headquarters in Zurich.

2        Sums insured

The sums insured are given in the Overview of insurance benefits.

3        Exclusively insured disputes and proceedings

3.1     Defence against negligence offences in criminal and administrative proceedings.

3.2     Assertion of extracontractual third-party claims as the victim of accidents of all kinds, as well as in assaults, theft and robbery.

3.3     Disputes with private or public insurance schemes covering the insured person.

3.4     Contractual disputes arising from the following contracts for the trip or concluded on the trip:

-     Hire or lease of a vehicle approved for use on the public roads, up to 3.5 t

-     Repair or transport of such a vehicle

-     Travel and accommodation contract

-     Temporary rental of a holiday home

-     Transport of people or baggage

4        Insurance benefits

4.1     CAP legal services benefits.

4.2     Cash benefits to the maximum sum insured per case of loss/damage during travel in the applicable European area and per case of loss/damage during travel outside the applicable European area (as long as this insurance option has been arranged) for:

-     Costs of expertise and analyses ordered by CAP, by the lawyer for the insured person or by the court

-     Court and arbitration costs

-     Compensation of the parties

-     Lawyers’ fees

-     Necessary translation costs

-     Bail (only as an advance to avoid imprisonment while under investigation)

The intervention costs awarded to the insured person during the proceedings or in a settlement will be deducted.

5        Settlement of a loss/damage case

5.1     The need for legal assistance must be notified as quickly as possible to:

5.2     The insured person must not instruct a legal representative, instigate legal proceedings, conclude any settlement or use any legal remedy without the agreement of CAP – with the reservation of precautionary measures to meet a deadline. In addition, the insured person must hand over to CAP all the documents relating to the case of loss/damage. If the insured person does not fulfil these requirements, CAP is entitled to refuse its benefits.

5.3     If the presence of an independent legal representative is necessary in court or administrative proceedings, in accordance with the applicable law of proceedings, or if there is a conflict of interests (two people insured by CAP are acting against each other, or an insured person is acting against a company in the Allianz Group), the insured person has free choice of legal representative. If CAP does not accept the proposed legal representative, the insured person has the right to propose three other legal representatives from various chambers, one of which CAP must accept.

5.4     In the event of differences of opinion between the insured person and CAP with regard to the measures used to settle the loss/damage, the insured person can demand judgement on the matter by an arbitrator appointed jointly by the insured person and CAP.

6        Non-insured events and benefits

6.1     If the insured person is not in possession of a valid driving licence at the time of the case of loss/damage, or was not authorised to drive the vehicle.

6.2     In disputes with tax or customs officials or in proceedings against counteractions against tax or customs directives (e.g. smuggling).

6.3     If the insured individual intends to act against CAP, the Mondial Assistance International AG, those acting on its behalf or people who provide services in the event of loss/damage.

6.4     If the case involves disputes or conflicts of interests between persons who are insured under the same policy (this exclusion does not relate to the insured person him-/herself).

6.5     If the requirement for legal assistance is notified after the end of the insurance cover.

6.6     Criminal and administrative disposition costs.

III      Special provisions relating to the individual service benefits

N       Travel Hotline

1        Service benefits

The listed Mondial Travel Hotline service benefits can be called upon by the insured person round the clock, 365 days a year, before as well as during the trip.

1.1     Travel information

Mondial-Assistance provides insured persons with important information before departure and by request, about conditions on arrival, charges, customs, currencies and health conditions.

1.2     Provision of hospital and medical practitioner contacts abroad

If necessary, Mondial-Assistance provides its insured persons with a correspondence doctor or a hospital in the area of the trip. Where there are problems of comprehension, Mondial-Assistance provides help with translation.

1.3     Advice service

Mondial-Assistance provides advice for insured persons for minor medical problems in the country of travel. The insured person can also turn to Mondial-Assistance with day-to-day problems in the country of travel.

1.4     Notification service

If the Mondial-Assistance centre has organised measures, it can also notify the relatives and employer of the insured person about the facts of the case and the measures undertaken, if necessary.

Mondial-Assistance accepts no liability for damage to assets or health resulting from the information given by the Travel Hotline.

1        Service provision

The specified 24-hour medical advisory service provision can be called upon while the insured individual is travelling, 24-hours per day and 365 days per year.

1.1     Advisory service

Mondial-Assistance will advise insured individuals with regard to minor medical problems in their country of travel.

-        Computer-assisted triage in the event of acute medical problems, with a recommendation on the urgency for treatment

-        Advice on questions regarding disease symptoms, progressions, therapies and prevention – in the widest sense with regard to health and sickness

2        Liability

Mondial-Assistance accepts no responsibility for loss/damage to property or restrictions on health resulting from information given by the 24-hour medical advisory service.

P       Credit and customer cards barring service (KKS)

The KKS is in operation round the clock throughout the year, and provides help for insured persons in the event of robbery, theft, loss or misplacement of bank, post, credit and customer cards, as well as personal ID cards.

All credit, bank, post and customer cards issued in Switzerland in the name of the insured person.

2        Insurance services

2.1     Following a call from the insured person to the Mondial-Assistance centre, an attempt will be made to bar all the specified cards via the relevant institutions (card companies, bank, post, etc.).

2.2     If the barring is not carried out by the relevant institution, Mondial-Assistance will inform the insured person and advise him/her of the telephone number of the relevant institution.

3        Insured events

Theft, robbery (theft with the threat or use of violence) and loss of the insured cards.

4        Liability

Mondial does not accept liability for loss/damage caused by the failure to reach the relevant institution, nor for loss/damage to assets as a result of the loss of credit, bank and post cards.

Q       Mobile phone barring service

Based on a call from the affected customer, Mondial-Assistance will arrange the immediate barring of numbers provided by the customer for the relevant provider. 1        Service benefits

If an emergency situation arises during the trip as a result of fire, damage by the elements, burglary or damage by water or breakage of glass at the insured person’s permanent place of residence in Switzerland, Mondial-Assistance will provide the customer with the telephone number of a suitable workman. This workman will be engaged by the customer and will undertake immediate measures to prevent any further damage.

2        Costs

The costs of the emergency repair of the damage will be borne by the customer, who will be invoiced directly by the engaged workman.

3        Liability

Mondial-Assistance accepts no liability for loss/damage caused by the inability to reach the relevant workman, nor for loss/damage or consequential loss/damage arising during and after the work carried out by the workman.

S       Callyandi – translation service

1        Service provisions

The Callyandi services listed here can be claimed around the hour by the insured individuals during the duration of trip covered by the insurance policy, subject to sufficient call credit.

1.1     Telephone interpreting service

1.1.1  The Callyandi telephone interpreting service is available free of charge to the insured person during the period of travel covered by the insurance

-     for a maximum total of 12 minutes (corresponding to 12 minutes’ Callyandi call credit) in the case of short-term insurance policies

         The aim of this service is to provide help in the event of difficulties of communication in foreign languages - subject to Clause 1.1.3 - such as when ordering in a restaurant, making a journey by taxi, asking for travelling directions, communicating with business partners, booking a hotel by telephone and many other situations in which someone who can speak the language of the insured person can solve a problem on their behalf.

1.1.2  The Callyandi telephone interpreting service offers the following languages: from German to Spanish, French and English. Additional languages will be introduced during the course of 2009.

1.1.3  The Callyandi telephone interpreting service explicitly excludes emergency situations in which legally-protected interests (life and limb, property, personal liberty, etc.) of the insured person or of third parties are at risk. In addition, the Callyandi GmbH General Terms and Conditions of Business also apply.

2        Liability

         Neither Mondial nor Callyandi accept any liability for loss/damage or consequential loss/damage resulting form the work of the Callyandi telephone interpreting service. This applies expressly and in particular to any improper use of the interpreting services for emergency situations within the meaning of Clause 1.1.3.

3        Additional call minutes subject to charge

3.1     Any use of the Callyandi telephone interpreting service beyond the call credit allowance according to Clause 1.1.1 is subject to charge.

3.2     If an insured person calls upon the Callyandi telephone interpreting service beyond the free-of-charge 12-minute call credit allowance (Clause 1.1.1), this will result in a binding contract between that person and Callyandi GmbH, on the basis of which the affected person will be liable to Callyandi GmbH for the additional call minutes. The price per additional minute is CHF 3.90 (including MwSt. [VAT]). In addition, the Callyandi GmbH General Terms and Conditions of Business will also apply; these can be accessed/obtained from www.callyandi.com/bedingungen.
